The following Terms and Conditions of Sale (“Terms and Conditions”) apply to the offer and sale of products through the website monicavarela.com (“the site”). You acknowledge and agree that these Terms and Conditions, along with our privacy policy, constitute the entire and exclusive agreement between us regarding your use of the website, and supersede and govern all prior proposals, agreements, or other communications. This contract will be formalized in Spanish and will be governed by Dominican legislation in accordance with Law No. 385-05 on the Protection of Consumer Rights, and all relevant supplementary laws and regulations. By accessing or using the site, you acknowledge that you have read, understood, and accepted, without limitation, these Terms and Conditions, and you are therefore subject to their provisions. General Provisions

The content of this website is for your general information and personal non-commercial use only. To purchase products on the site, customers must: (a) be at least 18 years old or, if underage, be duly authorized by their legal guardian, (b) be consumers, defined as natural or legal persons, public or private, who acquire, consume, use, or enjoy for personal purposes, (c) register on the website; and (d) have a valid credit card. Neither MÓNICA VARELA nor any third party provides any warranty, express or implied, regarding the accuracy, timeliness, performance, completeness, or suitability of the information, products, and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for such inaccuracies or errors to the fullest extent permitted by law. The use of any information or material on this website is at your own risk, and we shall not be liable. It is your responsibility to ensure that any product, service, or information available through this website meets your specific requirements.

Products

The products described on the site are offered and contain information in accordance with the provisions contained in Articles 33, 34, 45, and 46 of Law 385-05. The offered products are exclusively for personal and/or professional use. Customers are prohibited from purchasing with the intent to incorporate the products into a production process, transformation, resale, or services to third parties. Please note that we will monitor the purchases made through the site. We reserve the right, with or without notice, to cancel or reduce the quantity of products to be delivered to the customer when, at our sole discretion, it constitutes a breach of these Terms and Conditions.

Prices

All prices indicated for products available through the website include ITBIS and are denominated in US dollars. International shipping costs are the customer’s responsibility and will be added to the product price. These are listed separately on the order form.

Order Placement

To place an order, the customer must follow the instructions on the site. The customer may always change or remove products from the shopping cart or cancel the entire order during the “checkout” process before finalizing it. Before payment is processed, a notification will appear on the screen to redirect the customer to the store’s WhatsApp chat. Here, they will communicate with a store representative to inquire about the availability of the item. If the item is in stock, the processing time will be 24 hours. However, if the item is not available in stock, the customer has the option to request that it be made, which will take approximately 3 to 4 weeks. After confirming availability, the customer will return to the “checkout” page to make the payment or modify their order. By placing an order, the customer acknowledges and declares that they have read all the instructions provided during the checkout process. Once the order is placed, the customer will receive an email confirming receipt. If this confirmation does not arrive within 24 hours of placement, the customer may contact us for assistance at 809-350-8629. For faster service, customers are encouraged to have their order number available. Products will be charged to the customer at the time of purchase.

Payment Options

The customer may pay for products via PayPal, bank transfers, or credit card, with the following accepted: Visa MasterCard American Express Similarly, all credit card holders will be subject to the validations and authorizations performed by the card issuer. If the card issuer denies the transaction, or for any reason does not authorize it, either prior to or after the payment is made, we will not be responsible for any delay or non-delivery.

Order Information

Orders will be processed Monday through Friday, excluding non-working public holidays in the Dominican Republic, including: New Year’s Day Epiphany Feast of Our Lady of Altagracia Juan Pablo Duarte Day Independence Day Holy Week Labor Day Corpus Christi Restoration Day Feast of Our Lady of Mercy Constitution Day Christmas Eve (Working until noon) Christmas Day New Year’s Eve This list is indicative and not exhaustive, as it also includes days declared as non-working by the Dominican State, which may vary. All orders placed outside this schedule will be processed on the next business day. Orders will take an estimated 24 to 48 hours to process. For pre-ordered, out-of-stock, or custom-made items, the estimated processing time is 2 to 3 weeks. Please note that we cannot guarantee stock on all items. Shipping and Delivery Information

Domestic shipments will be made on business days between 9:00 a.m. and 6:00 p.m. Products will be delivered within a maximum of 7 days to any part of the country after the order has been processed. Shipments within Santo Domingo will be made to the indicated address. For shipments to other locations, an external shipping service provider will be used, and the customer must collect their order at the provider’s agency or establishment; information will be provided to the customer after the purchase. For all orders shipped outside the Dominican Republic, an external shipping service provider will be used. These shipments are made only on Wednesdays, so delivery time will depend on the order date. International shipping costs are the customer’s responsibility and will be added to the final price at checkout. Additionally, the customer is responsible for any customs duties or taxes incurred, as applicable and depending on the delivery country. International orders over USD 500.00 will receive free shipping. To pick up the order in-store, the customer may visit from Monday to Friday between 9:00 a.m. and 6:00 p.m. Pickups are only made at the main store, located at Av. Abraham Lincoln, corner of José Amado Soler Street, Edificio Progressus, Santo Domingo, Distrito Nacional, Dominican Republic.

Insurance

For added security, we require a signature upon delivery. If you choose to waive this, please indicate this in the comments section of your order and be aware that we will not be responsible for lost items.

Cancellations

The system may automatically cancel an order for one or more of the following reasons: Unavailable items; Inability to process payment information; Inability to deliver to the provided address; Duplicate orders; Cancellation at the customer’s request. If an order is canceled, the customer will receive an email explaining the reasons for the cancellation. No charges will be made for canceled orders. The customer may place a new order after a cancellation.

Mónica Varela jewelry is carefully handcrafted and conceptually designed by artisans in New York and the Dominican Republic with a high blend of sterling silver 925 plated with microns of platinum or 18k gold, microscopic fibers, and semi-precious stones of unique origin found only on our mother island. Designed for discerning women and men who wear jewelry with elegance and handle it carefully to ensure long-lasting use. The customer should avoid spraying perfume, applying lotions, or using chemicals around their piece. Avoid showering or swimming with the jewelry. Store the jewelry in our exclusive MVPouch or in a jewelry box with similar fabric padding after each use to keep them tarnish-free. Clean as needed with a polishing cloth.

Return Policy

Returns are allowed for new, unused, unaltered merchandise with proof of purchase within 15 days of purchase. Merchandise must have all tags attached and be in its original packaging. At the time of requesting a return and delivering the piece, the store will issue a credit note for the same value as the returned item, valid for consumption within 30 days. To return items sent outside the Dominican Republic, the customer must send the piece back to the Dominican Republic, and this shipping cost, as well as the cost to return the piece, are the customer’s responsibility. If the piece is received damaged or does not arrive in the condition specified in the previous paragraph, the return will not be processed, and the piece will be returned to the customer, who must pay the shipping cost as mentioned above.
